In't Veld Report: time for legal certainty and local self-government

Appeal to Members of the European Parliament from cities, local SGEI providers and public services unions

Joint press release, 21 February 2005

Cities, providers of local services of general economic interest and public services unions call
on Members of the European Parliament to amend the text of the In't Veld Report, adopted in
the Economic and Monetary Affairs Committee, in order to return to the spirit of the European
Commission's proposal:
- Supporting the Commission's proposal aimed to ensure legal certainty for local services
and taking into account the material impossibility for 100 000 local authorities in the EU
to notify the compensation granted to undertakings entrusted with the development of
high quality services which respond to the needs of the citizens and territorial
development;
- Supporting the Commission's approach to exempt from the prior notification
requirement those local services which do not affect the development of trade to such
an extent as would be contrary to the interests of the Community; reinforcing
transparency and local self-government through the definition of an official act that
specifies the precise nature of the public service obligation and the parameters of such
compensation;
- Opposing the suggestion of the Economic and Monetary Affairs Committee to make the
exemption from the notification requirement subject to the assignment of the public
service task by way of tendering procedure, which exceeds the provisions of
Community law and goes against the principle of local self-government;
- Proposing that the thresholds in terms of annual turnover and annual compensation be
determined on the basis of objective criteria following a study of a critical mass of cities
and local undertakings entrusted with the operation of services of general economic
interest and offering to contribute to such a study;
- Finally and most importantly, urging Members of the European Parliament to reestablish
the legal certainty for hospitals and social housing providers by opposing the
proposal of the Economic and Monetary Affairs Committee which reinserts the prior
notification requirement for fundamental social services, such as health and housing.
We also urge you to extend the exemption from the notification requirement to all social
services derived from solidarity policy and social protection.

In conclusion, we consider this to be a mere safety measure following the Altmark case and
that it is now the responsibility of the Community legislator to exclude state aids in the form of
compensation to services of general economic interest from EC rules on state aid.

POUR UNE SECURITE JURIDIQUE ET UNE AUTONOMIE LOCALE

Appel des villes, des opérateurs de SIEG locaux et des syndicats de services publics
aux parlementaires européens

Les villes, les opérateurs de SIEG locaux et les syndicats de services publics demandent
aux parlementaires d'amender le rapport In't Veld adopté en commission Economique et
Monétaire et soumis à la plénière dans le sens d'un retour à l'esprit de la proposition de la
Commission :
- En appuyant la proposition de la Commission visant à apporter une sécurité juridique
aux services locaux considérant l'impossibilité matérielle pour les 100.000 autorités
locales de l'Union à notifier les aides accordées aux opérateurs afin de développer des
services de qualité répondant aux besoins des citoyens et au développement des
territoires,
- En soutenant la démarche de la Commission consistant à lever l'obligation de
notification pour ces services locaux n'impactant pas les échanges dans une mesure
contraire à l'intérêt communautaire, tout en renforçant la transparence et l'autonomie
locale à travers la définition d'un acte officiel définissant clairement la mission de
service public, les obligations y afférentes et les paramètres de la juste compensation,
- En s'opposant à la proposition de la Commission Economique et Monétaire de
conditionner l'exemption de notification à l'attribution du service par appel d'offre, ce qui
va au-delà des dispositions du droit communautaire et à l'encontre du principe de libre
administration des collectivités locales,
- En proposant que les seuils en termes de chiffres d'affaire et de montant d'aide annuel
soient définis sur la base de données objectives après étude sur un échantillon de
villes et d'opérateurs de SIEG locaux , les signataires étant disposés à se prêter à une
telle étude,
- Enfin et surtout, demandent aux parlementaires de rétablir la sécurité juridique pour les
hôpitaux et organismes de logements sociaux en s'opposant à la proposition de la
Commission Economique et Monétaire consistant à réintroduire une obligation de
notification ou d'information préalable pour ces services sociaux de base que sont la
santé et le logement. Proposent également d'étendre l'exemption de notification à
l'ensemble des services sociaux relevant des politiques de solidarité et de protection
sociale.

Nous considérons par ailleurs qu'il ne s'agit que d'une mesure de sauvegarde suite à l'arrêt
Altmark et qu'il relève de la responsabilité du législateur communautaire de sortir les aides
sous forme de compensation de SIEG du régime d'interdiction des aides d'Etat.
